Performance Improvement Plan - in the US

Hi, 

Has anyone managed/introduced a PIP process with an employee in the US (At Will state)?

Although the employee is in an at will state, we still need to close in on potential risks, if at the end of the PIP the company decided to terminate employment. Especially as they disclose they have Dyslexia - a disability. 

How would you go about the length of the PIP, especially with the month of December most people being away on holiday?

  • I have managed this. I always believe that you choose a reasonable amount of time depending on the targets you are setting. I would never do less than a month and 3 is sort of average but you need to assess based on the requirement versus the performance gap and support needed.

    If people are away in December you may need to discount that month - they need to be given the opportunity to improve with support.

    I would also ensure that any accommodations needed are addressed first.
