New UAE labour law provisions - clause for fixed term contract duration

Hi 

We have one employee in the UAE and they are currently on an open ended employment contract via our company in region.  Given the new regulations we will need to amend their contract to a fixed term.   In our UK company if we have someone on a fixed term contract the clause regarding this is as follows:

Your employer is xxxxxxxxxx  (“Company” or “we”). Your employment is for a fixed term [of xx months/weeks* (*delete as appropriate)] starting on [Insert start date], and ending [insert end date]. The contract term may be extended by mutual agreement. No employment with any other previous employer counts towards your period of continuous employment with the Company.

Would this be ok to use in the amended UAE contract or does anyone have any other suggested wording they think may be more appropriate?

  • Hi Nicola, This looks fine. However the fixed term contract need to also mention how you are treating his/her current employment status. Continues to become fixed term? or terminated and issue a new fixed term contract? I think, there is time till Feb 2023 to implement and have some answers !!

    Hi Somanath - thanks that's helpful. I had assumed that we would have to terminate existing contract and issue a new one on the fixed term basis (this would be our preference as we also need to revisit the allowances package), but presumably we could make reference to the previous contract in terms of counting towards period of service (thinking about calculation of EOSG in the long term) - it is definitely helpful that we have until Feb 2023 to sort this!

    Just to add, you can make it automatic extendable and the latest is that there is no need for 3yrs cap as per earlier Govt announcement. Hope this helps
