Termination of employment

Hi everyone, I am new to the community and was hoping to get some advice. We terminated an employment contract on the 18th of March 2020 and the employee has agreed and took the termination letter. The last day is 8th if April 2020. Now the employee has come back saying to take them back and place on furlough. They have worked for the company for 18months and due to the covid 19 her job is no longer there as the production has been shut down and we are joy looking to open again. Can the company take the employee back and place on furlough even though the job is no longer there. Please can I get some advice . Thanks Asha

  • Yes you probably can but you dont have to is I think the current advice. There are risks in doing so in that you dont have a job at the end of the day for them and if this goes on for over 6 months they may achieve UD protection so be careful how you word it if you do
