Calculate Holiday on Termination

Hi all,

Just wondering which of these methods is correct, as my Finance Manager thinks it's the second method. 

Employee is entitled to 24 days + 8 bank holidays and works full time, 5 days per week

Holiday year 1st Jun - 31st May

Employee is terminating on 31 Aug 2017 and was present on 1st June

1. 32 days / 12 months * 3 months = 8 days accrued

OR

2. 24 days/ 12 months * 3 months = 6 days accrued

    As is often the case with the breed,  your Finance Manager is pretty clueless about employment law.

    The statutory minimum entitlement is based in between the two - on 28 days. Anything over and above that is a contractual matter: unless there's an express or implied right to it being based on 32 days, you can probably successfully argue no additional contractual right applies here
