Zero Hour Contracts and Holiday Entitlement

Can an employer cap holiday accrual at 224 hours per annum for a zero hours worker who may be working more hours than this in a year?

  • Assuming that the employee generally works an 8 hour shift when they do work, this would be the equivalent of 28 days annual leave which is the statutory minimum (5.6 weeks). If they usually work shorter shifts, it would be more than that so I assume it would be fine but I'm sure someone with more experience will be able to confirm.... We don't have any zero hours workers so I don't have any experience with this! Sorry!

    Edited just to add that if full-time employees are only granted the statutory minimum holiday, then I would have thought that capping it at that would be fair for zero hours workers.
