TUPE and Fragmentation in Northern Ireland

Hi

I was wondering if anyone had advice on TUPE and the 'fragmentation', as I have a contract due for renewal and the client has indicated 'fragmentation' may be a factor in the award of the contract.  Has anyone come across this and what is deemed fragmentation?

    The concept of ‘fragmentation’ in the context of TUPE (Transfer of Undertakings (Protection of Employment) Regulations) typically arises when a service previously provided by a single contractor is divided among multiple new contractors.
