Termination

Hi looking for advice, we have various people on fixed term contracts who we may have to bring to an end due to the current situation. One of the persons (4 in total) is pregnant and just wanted some thoughts around this. The decision to let go is purely preservation of workforce in these difficult times and at the same time we will be stopping all contractors - stage one of potentially more. Any thoughts of potential claim for unfair dismissal due to pregnancy?

    Provided you can demonstrate that you’re not putting this pregnant employee in particular to any detriment that’s related her actual pregnancy as opposed to the same situation as they all are in, then any potential claim is unlikely to succeed.
  • I suggest checking out the fixed term workers (prevention of less favourable treatment) regs...I suspect all your fixed term workers would have a claim if you did this!
