Contingent workers and organisations profit related scheme?

Pretty complex one here I think.

The issue is should contingent workers be paid a pro-rata portion of an organisations profit related scheme?

Does the organisation have to pay out on the revenue part and not the profit (AOIBDA) bit…. NOTE: The organisation have since been sold from their parent company so are in the midst of reviewing the old benefit pay out.

Is it a legal requirement to pay this under the  Agency Workers regulations? And there an obligation to pay out or not?

Any support on this would be greatly appreciated.

  • I answered my own question, Under the Agency Worker Regulations 2010 in section 6 (3) bonuses linked solely to company performance or to reward long-term loyalty, or linked to a financial participation scheme are excluded from pay.
