Settlement status

Hi All

Please can you advise how you are ensuring ongoing right to work compliance re settlement status with non UK citizens?

I understand we need to be mindful as to how we approach non UK workers and that it is their responsibility to have the right to work, but would like to be in a position to encourage compliance with this and would appreciate feedback on any approaches taken / considered.

    Until 30th June you continue to check as you usually would. There is still no clear guidance as to what the checks will be after 30th June. It will likely be that those who have settled status will be issued a code and you can check this on a government website, similar to licence checks.

    I've just seen something in the Free Movement Weekly Newsletter about recently published Home Office guidance for immigration caseworkers on how to deal with this: - pages 26 to page 44 of the main caseworker guidance (mind you it's heavy going!)

    In terms of our own process, we are asking people to confirm they have the right to work but only requiring an EU passport at the moment unless we know they have not been in the UK (e.g. they have applied from outside the UK)  in which case we ask if they have Pre or Settled status, otherwise we need to sponsor them.

    Where you are asking people to confirm they have the right to work, is this in line with your usual right to work checks or is this an additional check in readiness for these changes?

    Hi Laura,

    It's part of our standard right to work checks. We hold sponsorship licences already so have always taken a strict approach to RTW checks. I've been regularly reminding EU staff of the need to apply for the EUSS (though not requiring them to tell us if they have it) as they will need that status to, e.g. get a mortgage, change bank accounts, rent accommodation, renew their driving licence etc after June.     *"Helpful" not being a phrase I use often about the Home Office!
