Safeguarded Salary

Hi,

Please could someone clarify entitlement to a Safeguarded salary?

We have a teacher who lost his TLR role in September 2018 so his TLR payment is safeguarded for 3 years.  However, he has just made a request to reduce to part time.  As the request has come from him, does he still retain the right to his safeguarded TLR payment?

Any assistance on this point would be much appreciated.

    He would still retain his safeguarded sum but this would be pro-rata'd in line with his part time hours.

    I know this is an old post but don’t know if you might be able to help.

    We have a teacher who has 2 years left remaining of a safeguarded amount which was originally £2900 per year on top of their L2 salary. They have progressed to L3 from Sept 20 and with the 2.75% pay award it is been suggested this safeguarded amount needs to reduce down to approx £700 so there gross salary does not increase to what they had in Sept 19. Is this correct?

    Yes used to get TLR for SENCO/ Senior leadership team role . School restructured and became an academy and staff member became Assistant Head with SEN responsibility but on leadership pay scale.

    We have taken the stance that a teachers salary will increase in line with the increase in scales on the basis that they are doing the job and should not lose out on cost of living rises. The safeguarded amount of the TLR payment that they have lost, will remain the same for the full 3 years. However, I think your circumstances are slightly different in that they are on the leadership scale - point 34.3 in the STPCD states "payment of a safeguarded sum which is attributable to the circumstances described in paragraph 29.1 (c) must be discontinued whilst the teacher occupies a post as a member of the leadership group ………." so I'm afraid my response has to be to read through the STPCD and see if you can decipher it! Sorry I can't be more helpful but I wouldn't want to advise incorrectly.
