Change of date for early May bank holiday

A member of school support staff who normally works Mon-Thu, term time only has asked if they will be entitled to salary adjustments or additional time off because the early May bank holiday has been moved from Monday to Friday this year. The employee feels that they are "losing" out on a bank holiday as the new bank holiday date coincides with their day off rather than a working day. I have not yet had sight of the employment contract but am wondering if any HR people out there have dealt with similar queries about this change of date and it's impact on leave/pay.

  • Yes, and the simplest way of explaining that it doesn't make any difference how the bank holidays fall is by reference to hours of holiday rather than days ....the part timer working 4 days a week in term time is still entitled to 12.07 % of total hours worked in a year, irrespective of when bank holiday falls.
    The calculation needs to be done in hours rather than days. The 12.07% calculation is 5.6 weeks' holiday ( incl.stat hol) ÷ 46.4 weeks (52 weeks - 5.6 weeks) x100
  • Your employee has been disproportionately benefiting for the length of their employment. Its why most people switched BH accrual from days to hours. They have benefited from getting every monday off rather than 4/5ths of the time. Taken in isolation they may have a case, but taken in totality to win this year means they should "lose" in future years.
