Teacher Adverts . . .

Hi, I'm wanting to gain some advice with regards to teacher recruitment. Is it legal to advertise a permanent teacher post on pay scales M1 to M6 only (due to budget restraints) and not pay UPS scale. Am I open to age discrimation challenge under the Equality act?

    You cant advertise based on the salary scale as, as you suspect, you would be discriminating against older teachers.

    If it's a school covered by the STPCD, my understanding is that since there is no longer pay portability then the school is free to advertise the post on your MPS. This seems to be quite common at the moment. You'll need to ensure that you comply with your school's pay policy. However, there nothing stopping a new employee from then applying for UPS once they've been recruited, and once they've met the criteria.

  • It depends on the needs. You can just write MPS and then add Newly Qualified Teachers welcome to apply. This implies that the role does not require a very experienced teacher.
