Paternity Leave for Teachers

Hi

I was wondering if you have had any experience of a full time teacher taking paternity leave when the baby is due in the summer break - technically they would have had all their holidays from Sept but is this fair that they don't benefit from the two weeks (we give full pay) paternity leave if this falls in the summer break - or would we give them the two weeks back as TOIL? 

Your thoughts or experiences would be appreciated.....

  • Statutory Paternity Leave can be taken at a later date but It must end within 56 days of the birth.
  • Under teachers T&Cs school holidays are not contracted working time, thus, cannot be recorded as any type of absence, including paternity leave (you wouldn't mark them as sick if they were unwell).

    As Deborah says, the SPL must be taken within 56 days of baby being born.

    We've had two teachers whose babies arrived during school holidays and they have taken their paternity leave straight after the holidays.
