Teacher resignation

Hi,

I have a teacher who has given the required notice for resignation for 30th April. However, the teacher has left earlier than 30th April (last day of Spring Term) and not continuing in employment with HT agreement. Should the teacher be paid up until the Easter holidays or up until 30th April?

  • Unless I'm missing something if someone leaves, regardless of notice, they are paid up to the last date of employment.

    Colleagues immersed in t and c of teachers subject to the usual national conditions of service will surely correct me if I'm mistaken, David, but their employment and pay normally continues unchanged during school holidays but they are contractually prohibited from leaving other than at the very end of a school term - and must put in their notice of intention to leave on a termly-only basis.

    Perhaps we haven't got the entire context here, Lily, as usually, if it's a school in England, 24 April would have been the start of the Summer Term with the school having closed at the end of the previous term for the Easter Holidays a bit after the beginning of April. It would usually have been very much not in the best interests of the teacher involved simply to push off from their employment before the school closed for the Easter Holidays and to risk not getting paid up until the end of term, whatever exact date at the end of April that was. And, most things preventing them from being at school before the start of the Easter holidays could one would have thought have been covered by sick leave or similar,

    But if the teacher involved really and demonstrably has ended their employment before the end of term, then I'd fully agree with you, David that their pay stops as at that exact end of employment date.
  • Hi - I think you may need to check with the Headteacher in terms of what they agreed with the individual about the date they would be paid to. However, when I worked with schools, it was quite common for the Teacher to be paid to the end of the month, but actually finish work when the Easter holidays started. The main reason was that it was disruptive to the teaching for them to come back in for a week or so after Easter.
