Pregnancy and the acceptance of a new role (in a school)

We are currently going through a reorganisation where we are reducing the number of TLR holders.

A pregnant woman has applied for and been successful in securing a role with a TLR, but she is currently a TLR2b and the post she has secured is a TLR2a. The new roles come into effect from 1st May, but she is due to go on mat leave on 1st March.

Just want a second opinion - do we have to protect her TLR2b salary whilst she is on Mat leave and then she reduces to TLR2a on return? Or can we apply the TLR reduction whilst she is on mat leave, as she applied for and was offered the new post before the mat leave started?

  • The calculating weeks for maternity pay are set (around 20-24 weeks as I recall), so her maternity pay would be based on the higher salary I presume.
