Term Time - can annual leave be claimed back during a period of long term sickness absence

We are putting together some Guidance for Managers on Term Time Working and wondered if you are able to clarify for me, if staff  who work Term Time and have a period of long term sickness absence which falls when the Schools are closed, are they able to claim back the annual leave on production of a medical fit note?

Any guidance would be much appreciated.

    You cannot be sick on non-working days, for example, sickness that falls during school holidays should not be recorded on absence records.

    The issue arises as to when you allocate holidays to be taken outside of term-time (as not all of the 13 weeks is 'holiday'). Most schools pay salary across 12 equal monthly amounts, so you will need to calculate the holiday entitlement for the period of LTS, then allocate holiday days/pay accordingly on the employees return.
