Support Staff with multiple roles working over 37 hours

Hi everyone, 

I have a question relating to the Green book. We have a member of staff who is employed as a teaching assistant for 30 hours a week, and an MSA for 2.5 hours. They would like to take on the role of minibus driver which is 8.25 hours a week, taking them over 37 hours. How should this be implemented? It seems to me that any hours over the 37 should be paid as overtime but I am not sure. 

Any advice gratefully received.

    Does your contract have a clause regarding multiple duties?

    Under our contracts, each duty is treated separately, however, we have a commitment to work life balance and as a general rule do not allow total contracted hours over the FTE.

    Thanks for your response. Our contracts have been inherited from an old HR provider and do not have such a clause. I referred to the Green book which I think says they shouldn't permanently work over the FTE. The problem I have is that the old HR provider has allowed multiple contracts taking staff over the FTE permanently.
