Sunday working

Our organisation has a policy where you can opt out of Sunday working providing you give 3 months notice. Is there a case against this not being approved? The handbook just stipulates that during their 3 months notice the company can still require them to do the Sunday work that their contract provides. Please advise

  • If the business routinely requires Sunday working then there are a number of grounds on which one might seek to opt out.

    First, one may seek to do so as part of a flexible working request, subject to the normal scrutiny and limitations of such.

    Second, one may opt out as part of opting out from having previously opted in to Sunday working in order to permit working in excess of the 48-hour limit on weekly working hours in the WTR.

    And, third, one may opt out as a request for reasonable adjustments to accommodate a religion or faith if you are part of a Christian denomination that strictly observes Sunday as a day of rest.

    Finally, of course, the business can have its own discretionary position on Sunday working opt-outs, based on the needs of the working site in question.
