Shift Patterns / Night Work

Hi all

I have recently moved company and my new employer has a number of colleagues covering 24/7 managed services which I have never dealt with before.

The shift patterns were recently reviewed and the colleagues voted in favour of the DuPont Model - 14 x 12 hour shifts (inc. 1 hour break) in a 28 day cycle. 7 are day shifts and 7 are night shifts. My question is in relation to the fact that a night worker must not work more than an average of 8 hours in each 24 hours (calculated over a reference period of consecutive days or 2 months. How is the average calculated?

    I think you will find that the 1998 WTR allow this requirement to be disregarded in cases where a collective or workforce agreement has led to adoption of a different working pattern.

    So long as you keep a record of the workforce vote and subsequent agreement, there should be no problem ( our daughter works 12 hour night shifts on a regular rota, and that’s in the County Police Force Control Room!

    Thanks David. Is this the same case in Ireland as I think we have slightly different Working Time Act rules.

    Sorry Aoife, not sure about ROI rules - both stem from the EU Working Time Directive and that document might have similar provision - possibly
