Hello all, I’m wondering if anyone can help me out here. I have an employee who has requested to be placed on a Band E contract guaranteeing them a certain amount of hours. However, since then she’s consistently called sick for one or two shifts a week. My question is that if they are unable to commit to the banded hours they’ve requested are we legally able to bring her Band down a grade as it’s taking hours from staff that are in need of them. I’ve not been able to find anything and her old contract remains the same so can we rescind the band E agreement due to her not being able to work the agreed upon hours? Any help would be appreciated!
