Hiring UK Nationals in Bahrain

I work for an aviation company and we are exploring the option of setting up an operating bases in Bahrain.  There are a lot of things to be considered, but I've been asked to consider the 'People' aspects.  

The current management thinking is that we will employ UK Nationals who we will fly out to Bahrain to undertake their duties (pilots and engineers) and then after their rostered period (say something like 4-7 days for arguments sake) they will return home and we will just rotate the crews.  

However, this doesn't feel right to me, I am sure we would be breaking some kind of right to work laws in Bahrain, because if they are working in Bahrain they will need Visas etc.  A quick google tells me we need to be operating in Bahrain, registered with the LMRA and maintain a specific percentage of Bahraini workers. 

I'm going to need to seek some professional advice on this to ensure I can relay accurate information to our management team.  Would anybody be able to recommend a professional services company or law firm that would have the correct knowledge and experience of Bahrain that could help me?

    A very interesting operational challenge you have here - Immigration law, Trade union (Bahrain has a very active one), International assignment, UK vs Bahraini tax and employment laws etc.
    Do you still need a recommendation for an immigration lawyer with Bahraini experience or are you now sorted?

  • Hi Louise, if you're looking for legal advice you could contact the Middle East offices of firms like Pinsent Masons or DLA Piper, who have employment advisory services across the region. Usually companies setting up a base in Bahrain would have employees permanently located in Bahrain - this could be any nationality (including UK nationals), provided they have a valid employment visa with the local company. It would be normal to include provisions for accommodation, private healthcare, etc. as part of the local package.
