Hi everyone,
I was wondering if there is anyone who knows the China employment law, specifically the element of overtime. What I have so far found out is that employers are bound to pay overtime carried out during working week at 150% normal hourly rate, during weekend this goes up to 200% and any work done on Public Holidays is at 300%. Now what I need to know is whether we as an employer are allowed to offer time of in lieu instead of payment. I have been told by my colleague in China that this is only possible for overtime done during weekends but not during week or on Public holiday.
If you have experience with operating in China can you please let me know what is your company doing about overtime?
