Annual Leave during probation period

Hi All,

I need your advise on annual leave during probation period. I know that new joiners cant utilized any leave during probation period however after completing their probation period successfully they are entitled to 2 days per month till completing a year. So do we include the 6 months probation period in the calculation.

Is it 6 months x 2 or 12 months x 2

    Annual holidays are a statutory right with a minimum of 28 days pa including bank etc holidays and it;s also a statutory right that entitlements accrue from the very first day of employment, irrespective of any probationary periods, which are purely contractual and not recognised or regulated by statute.

    If a new starter hasn't accrued sufficient annual leave to cover the time off they need then the employer can refuse to allow it and / or to pay holiday pay for it, but the minimum statutory entitlement still accrues, so in your example it's definitely 12 months times 2 days per month
