Annual Leave after probation period - Middle East (UAE)

As per the labor law in UAE, new joiners are not entitled to any paid annual leave during probation period. They are though entitled to 2 days leave after their completion of probation period. So my question is, after the completion of the probation period, do we count their annual leave balance from the joining date or from the month they completed their probation period. For example if an employee joined in January and they completed their probation period in June, do they get 12 or 24 annual leave balance.

    It will be 12 days accrued leave as it is prorated and they accrue 2 days for each month of service.

    while the UAE labour law does not entitle employees to take any of their accrued leave during their notice period, your company can still allow them to take it.

    This will also help you manage their annual leave. You don't want them to take 24 days during months 7-12 of their employment (almost a week every month!) and carrying over annual leave is often not an effective solutions, either.

    Hi Despoina, the UAE law offers 2.5 days every month= 30 days after 12 months of service. After 6 months the employee can get 15 days annual leave. It is up to the company to allow them to take the full annual leave before they serve 12 months in their role. From experience, i prefer to give them their 30 days before they finish 12 months as this allows for more flexibility to manage the rest of the team, you don't want everybody to take 30 towards the end of the year. Also to consider that since the employees are mostly expats, they might want to take their leave in full as they don't need to spend to pay a second ticket themselves. Hope this helps.

  • Hi Despoina, the UAE labour law offers 2.5 days per month of service = 30 days after 12 months. When the employee completes 6 months of service they can take 15 days of leave. It is up to the company to give the full 30 days of leave before the employee service 12 months. This actually helps to manage better the leave as you don't want everybody to take 30 days towards the end of the year. As the employees are usually expats, it also helps them not to split their leave and pay for a second ticket. Hope this helps.

    Your replies are really helpful, however I wanted to ask if you know what most companies follow here. Do they give the full 30 days annual leave to all employees or just what they are entitled to.

    Hi Despo,

    it's a real mix with some companies (in particular local ones) only giving what's mandated, some enhancing it to 25 calendar days while MNCs leaning towards 30 calendar days. Whatever you and your organisation decide should fit into your overall total rewards strategy.
