Industrial Accidents and sick pay

Can you help a very tired brain out?!

If a policy states 

Absence through normal sickness is entirely separate from absence due to industrial disease, accident or assault arising out of or in the course of employment with a local authority.  Periods of absence in respect of one shall not be off set against the other for the purpose of calculating entitlements under the scheme.

If someone is entitled to 6 months full pay and 6 months half pay and they had 5 months off due to an accident at work then 2 months off due to general illness should they be on half pay or should the 5 months off due to the accident not be added to the other absences?

  • I would read your text to mean that the first 5 months give full pay; and then they are entitled to up to 6 further months (for non-industrial accident sickness) on full pay, before half pay kicks in for up to 6 months. This is because there is no "offsetting"

    I would also read it as any absence for the reasons listed are on full pay and do not count towards sick pay entitlements.

    If you are under the green/burgundy books this is definitely the case, and contagious diseases do not have to be industrial e.g. any time off for covid-19 cannot be deducted from sick pay entitlements.
