Return to work after illness

A teacher has returned to work after exhausting her sick pay, she came back on a phased return and is now off again, does her entitlement start again or would it still be nil pay as it resets again in april, any advice would be appreciated

  • If the sickness year restarts in April each year and she has exhausted her entitlement for April 2019-March 2020, then she won't be entitled to any more sick pay until April 2020.
  • OSP is normally on a per annum basis and might re-set with the financial year, holiday year or tax year; or it might be calculcated on a rolling 12-month basis so you don't re-set your entitlement until 12 months after the start of the absence that first triggered OSP.

    The correct answer will depend upon the precise Ts&Cs. Is this teacher on burgundy book Ts&Cs or part of an Academy Trust, Free School or Independent School with its own Ts&Cs?

    Yes we are burgundy book, i read it that she should be nil pay but wondered what others thought, cant find much out about this

    We have a similar situation and I understand that it will be nil pay until 1 April 2020, when it re-sets.
